Family sponsorship: a program for reuniting relatives

Family sponsorship is a federal-type immigration program whose main objective is to reunite relatives in the same province on Canadian territory. This option is aimed at citizens and permanent residents who are planning to move their family to Canada for permanent residence.

Presented sponsorship is possible with a maintenance obligation. Undertaking is a certificate confirming that the relative who is migrating will be financially supported. Its validity is determined by the age and status of the person. What time periods are worth targeting:


  • Spouse/spouse/marital partner - no more than 3 years.

  • Children under the age of 22 - 10 years. Also may be taken into account if the person is under the age of 25. If children have already turned 22 at the time of the move, no more than 3 years.

  • Immediate family members, parents and grandparents - 20 years.

Before planning, be sure to review the list of relatives who can immigrate under the program presented. What to consider when choosing this method of family reunification:

  • The sponsored relative is not eligible to receive government financial assistance - welfare.

  • If you apply for welfare before the certificate expires, you will need to reimburse the costs that were allocated to support the immigrant. Thereafter, the sponsor is ineligible to fund other relatives.

Be sure to adhere to these rules so that you do not run into problems with government agencies later on. Notify your family. In the event of a violation, there will be difficulties in moving all relatives.



List of Relatives

The category of closest family members includes spouses (partners whose marriage has not been officially registered are also counted); children under 22 years old (natural and adopted); parents and grandparents of the one who is sponsoring; orphans under 18 years old, if they are brothers, sisters, grandchildren, nephews to the applicant. If the sponsor is unmarried and has no siblings, he/she gets to carry brothers, sisters, nephews, and grandchildren.

Note that only couples who are officially registered are considered to be married. If the marriage took place outside of Canada, you would need a marriage certificate from the other country. It must meet all Canadian requirements. If the registration took place in one of the provinces, you would simply need a Certificate of Marriage.

The situation with civil marriages has its own specifics. This type of cohabitation falls under the category of sponsorship. It requires proof that the spouses have been in a relationship and have lived together for more than one year (no interruptions!).

Sponsorship may be denied if you are married to someone under the age of 16.

People who are currently married (even if they do not live with your partner or are divorced) cannot sponsor a partner who is legally registered with another person.

You must have lived together in the same area for more than a year to confirm your relationship.

What do I need to know about unofficial marital partners?

They can be "spouses" whose relationship is not registered with the state. To qualify for sponsorship, you must provide proof, for which this will apply:

  • Living together for one year or more.

  • Joint account, credit cards.

  • Joint ownership of property (apartment, house, car).

  • Common rent payments, utility bills.

  • Joint registration at the place of residence.

Matrimonial partners are another category considered by the program presented. Who can rightfully fall into this segment:

  • Those who are unable to formally register their relationship because they live in different countries or have another immigration barrier.

  • One partner is still married in a country where there is no official divorce.

  • Refusal to register due to sexual orientation, as same-sex marriage is illegal in many countries.

The marital partner can act as a sponsor only after evidence has been presented that official registration is not possible. This can be the law of another country, studies or living in different countries.

Those who want to support orphaned relatives will need a written agreement from the legal guardian. This measure applies to minor relatives. After this agreement, the candidate can safely leave the country in which he or she currently resides.



Registration: Requirements for applicants Organizing a family sponsorship is done in stages. First, permission for the procedure must be obtained. Second, the relative who will move under the program must go through all immigration processes. The requirements that must be met by the one who will support his family:

  1. Age - 18 years or older.

  2. Resident of Canada.

  3. Compliance with all financial government requirements.

  4. No maintenance benefits for the applicant himself/herself.

When you will not be able to be a sponsor:

  • You have violated sponsorship conditions.

  • You are in debt for child support.

  • You are on government assistance (disability does not count).

  • You have a criminal record for a sexually violent crime that was directed at a loved one or relative.

  • Delinquent and missed immigration loan payments.

  • You are or have been in prison.

  • Declared bankruptcy and have not been released from that status.

After verification, a contract is signed with the Department of Immigration. The visiting family member must also fill out form IMM1344B on the official Sponsorship Agreement document.

  • If the registration has taken place in other territorial regions not on the official list.

  • If the sponsored partner is already married to another Canadian citizen.

The company's experts will provide detailed advice and information for those who plan to participate in the program. Thus, the applicant will definitely need to confirm their financial situation in order to move their relatives under the terms of the sponsorship. Only then does the immigration processing begin.

An additional plus for the inspector will be the signing of an agreement in which the sponsored relative agrees to make every effort to become financially independent as soon as possible. This agreement applies to family members who are at least 19 years old.

Required Documents It is recommended to prepare documents at once for all participants in the program. In 2016, technical changes were made to the application package. The updated packet of documents must include the following:

  • The Fees Receipt portion, which confirms payment of the application fee. It must be stamped and certified by the payer's bank.

  • Completed Form IMM 1344A, Application to Sponsor a Member of the Family Class and Undertaking.

  • Sponsorship Agreement with all information and signatures of both parties.

  • Financial Evaluation Form - only IMM 1283 and Document Checklist - only IMM 5287.

  • A copy of the document of the citizen who will sponsor you.

  • Evidence that proves kinship. Certified translations of the certificate of marriage or divorce, death, adoption are considered official in this case. In the case of the parents' transfer, a birth certificate will be required.

​ Do not forget that only translations with official certification according to the requirements, which are typical for the country, which accepts the migrant, are attached.


How to Prove a Sponsor's Welfare Before any case is considered, a background check is conducted on the applicant. What you need to provide in order to prove your financial readiness to accept your relatives:

  • A printout of forms T4, T4E, T5, T5007. These are free of charge upon application to Revenue Canada.

  • Original letter from your employer. It must include your annual salary and how long you have been with the company. Weekly hourly earnings must also be included.

  • Photocopies of paycheck stubs for the period in question must be included.

  • A copy of the T1 from the Individual Income Tax Return Form.

  • If you are not working, photocopies of applications for state or welfare benefits will need to be attached.

  • Information about all income that was earned during the period under review.

Initially, the verification begins by reviewing all of the applicant's documents. It must pass the basic requirements. If the parameters are met, the Case Processing Centre sends a set of documents to the Canadian embassy of the country where the future immigrant currently resides. Next, the applications are examined and the visa interview takes place. If there are no questions, the sponsored person gets the opportunity to go to Canada for permanent residence under the category of family sponsorship.

Please note, the applicant is required to pay a Processing Fee. If the immigration was denied as a result, the sponsor will be refunded all of their processing fees.

What to do if immigration has been denied If your family member cannot obtain permission to enter the country this way, choose another immigration option. The easiest and fastest option is through Express Entry service. Your relative is automatically added to the government's professional human resources database. Canadian employers review and select candidates who qualify for current job openings. That way your loved one can get an official offer, which will increase his or her chances of entering the country.
